These terms apply to all photography and videography services provided by Caught n' 4k ("we," "us," "the Photographer") to you ("the Client"). Booking a session, paying a retainer, or signing a service agreement means you accept these terms.
1. Services
We provide photography and videography services as described in the package, proposal, invoice, or written agreement you select. This may include wedding coverage, event and commercial coverage, engagement and proposal sessions, portraits, headshots, family sessions, short-form video, and edited photo and video deliverables.
The exact services, coverage hours, deliverables, location, and price are confirmed in writing before we begin. Anything not written down is not included.
2. Booking and Retainer
Advance notice. Sessions booked through this website require a minimum of 14 days' notice. If your date falls inside that window, book a free consultation call and we will tell you honestly whether we can accommodate it.
Reserving your date. A date is not held until the Client has paid the required retainer and, where applicable, signed the service agreement. Verbal agreements, email confirmations, and filled-in enquiry forms do not reserve a date.
Retainer amount. Weddings and full-day event coverage require a 30% non-refundable retainer. Sessions booked directly through the website are paid in full at the time of booking.
What the retainer is for. The retainer is not a deposit against services. It compensates us for reserving your date, declining other enquiries for that date, and carrying out planning and administrative work. It is applied toward your total fee and is non-refundable in all circumstances except those described in Section 6.
3. Payment
The balance is due 14 days before the event or session date unless otherwise agreed in writing.
We are not obliged to begin editing, deliver files, or release gallery access until payment has been received in full. Late payment will delay delivery, and the delivery timelines in Section 7 do not begin until payment clears.
Payments made online are handled by third-party payment processors. We do not store card or bank details.
4. Additional Coverage and Scope Changes
Your package includes only the hours and deliverables stated in your agreement.
Additional coverage time may be added on the day at our discretion and subject to our availability, billed at the applicable hourly rate and invoiced afterward. Additional deliverables, expedited editing, added locations, or expanded scope must be agreed in writing and may carry additional fees.
Travel. Coverage within 40 miles of Detroit, Michigan is included. Beyond 40 miles, travel is quoted separately and agreed before booking.
5. Client Responsibilities
You are responsible for providing accurate event details, timelines, addresses, contact information, and any shot list or special requests at least 7 days before the date.
You are responsible for securing any venue permissions, permits, or access required for us to photograph or film, and for informing us of venue restrictions in advance.
You are responsible for the conduct of your guests and attendees.
We are not responsible for missed images or footage, restricted coverage, or delays caused by inaccurate information, late arrivals, schedule overruns, venue restrictions, missing permissions, or participants who are unavailable when scheduled.
6. Cancellation, Rescheduling, and Our Obligations
If you cancel. The retainer is non-refundable. If you cancel within 30 days of a wedding or full-day event, the full balance remains payable, because the date can no longer realistically be rebooked.
Sessions booked online. Free cancellation up to 7 days before. Inside 7 days, the fee is non-refundable. Reschedules are accepted up to 3 days before, subject to availability.
If you reschedule. We will make reasonable efforts to accommodate a new date. Your retainer transfers to one rescheduled date within 12 months. If we are unavailable for your new date, the cancellation terms in this section apply.
If we cannot attend. In the event of illness, injury, emergency, or circumstances beyond our control, we will make every reasonable effort to send a qualified replacement photographer of comparable standard at no additional cost to you. If no replacement can be arranged, we will refund all monies paid, including the retainer. This refund is our complete liability in that situation.
Weather and safety. For outdoor sessions we may recommend rescheduling or relocating for unsafe or unsuitable conditions, at no charge. We are not required to work in conditions that are unsafe, illegal, or that present a risk of harm to people or equipment.
Circumstances beyond control. Neither party is liable for failure to perform caused by severe weather, natural disaster, venue closure, serious illness, accident, government restriction, or other events outside reasonable control.
7. Delivery
We commit to the following delivery timelines, beginning once final payment has cleared:

Portrait, headshot, engagement, and proposal sessions: within 7 days

Family sessions: within 10 days

Event and commercial coverage: within 5 business days, plus a same-day social selection where included in your package

Weddings: a preview set of 15–20 edited images within 48 hours; the full gallery within 6 weeks; highlight films within 8 weeks
If we expect to miss one of these dates, we will tell you before the deadline, not after.
Delivery is by private online gallery or digital file transfer.
8. What Is and Isn't Included
Deliverables are the edited files described in your package.
RAW files, unedited files, rejected or duplicate frames, test shots, and raw video footage are not included and are not available for purchase unless separately agreed in writing.
Editing included: colour correction, exposure and white balance adjustment, cropping and straightening, basic blemish removal, audio balancing, and sequencing.
Not included: advanced retouching, object or person removal, background replacement, body reshaping, heavy skin work, or special effects. These may be quoted separately.
Photography and videography are creative services. Final work is captured and edited according to our artistic judgement and established style, which you can review in our portfolio before booking.
9. Video Revisions
Video projects include two rounds of reasonable revisions. Requests must be submitted in writing within 7 days of receiving the first draft.
Reasonable revisions include adjustments to music, text, clip selection, sequencing, and minor edits. They do not include a full re-edit, a change of creative direction, additional filming, advanced effects, or anything outside the original scope.
Additional revision rounds are billed at $150 per hour.
10. Copyright and Usage
We retain copyright in all photographs, video, and creative work produced.
Personal clients receive an unlimited personal-use licence: you may download, print, share, and post the final edited files for personal purposes, including sharing with family, friends, and wedding participants. Print release is included.
You may not sell the files, license them to third parties, submit them to competitions or publications, or use them for any commercial or promotional purpose without our written permission. Please do not apply filters or re-edit the images before posting — it misrepresents the work.
Commercial and corporate clients receive full commercial usage rights to the delivered images for the agreed purposes, as specified in your agreement.
Credit to Caught n' 4k when posting online is appreciated and never required.
11. Portfolio Use and Model Release
We will use images or video from your session for our portfolio, website, social media, or advertising only with your approval. You may decline, and declining will not affect your service or price in any way.
If you approve, you grant us permission to use the approved material including your likeness for those purposes. You confirm you have authority to give that consent for yourself, and you agree to tell us before the date if any participant should not be photographed, filmed, or shown publicly.
You may withdraw approval for future use at any time by contacting us. We will remove the material from anywhere we reasonably control, though we cannot recall material already published or shared by others.
12. File Storage
We store final edited files for 90 days after delivery. You are responsible for downloading and backing up your files within that window.
After 90 days we may delete galleries, files, and project data without further notice. Re-delivery after that point may be possible but is not guaranteed and may carry a retrieval fee.
13. Meals and Breaks
For coverage of six hours or more, please provide a meal and a reasonable break, served during the event's own meal period so that coverage resumes before speeches or key moments.
14. Conduct and Safety
We reserve the right to stop coverage and leave in response to harassment, threats, intimidation, unsafe behaviour, illegal activity, or any situation presenting a risk of harm. In that event, no refund is due and the full balance remains payable.
15. Limitation of Liability
If images, video, or files are lost, damaged, or not captured due to equipment failure, memory card failure, technical fault, illness, emergency, venue restriction, unsafe conditions, incorrect information supplied by you, or circumstances beyond our control, our total liability is limited to the amount you have paid for the affected services.
We are not liable for indirect, incidental, emotional, consequential, or special damages.
We take redundancy seriously: every shoot is covered with spare batteries and memory cards, and every frame is written to two memory cards at once, inside the camera, as it is shot.
16. Quality
Final quality may be affected by available light, weather, venue restrictions, crowd movement, background conditions, ambient audio, guest behaviour, and schedule delays.
We will always work to produce the best result the conditions allow, but we cannot guarantee specific poses, reactions, angles, lighting, or moments that fall outside our reasonable control.
17. Changes and Governing Law
Any change to services, price, deliverables, date, time, or location must be agreed in writing by both parties.
The laws of the State of Michigan govern these terms.
If any provision of these terms is found unenforceable, the remaining provisions continue in full effect.
